Fulfillment of the Rights of Persons with Disabilities in Yogyakarta Under DIY Regional Regulation No. 4 of 2012

This study aims to analyze the conformity between the Regional Regulation of the Special Region of Yogyakarta Number 4 of 2012 concerning the Protection and Fulfillment of the Rights of Persons with Disabilities and Law Number 8 of 2016 concerning Persons with Disabilities.
The research method used is normative legal research with a descriptive nature, based on secondary data supported by primary data, and analyzed using deductive logical reasoning.
The novelty of this research lies This research does not merely examine legal norms from a normative perspective, but also measures the level of alignment between regional regulatory mandates and their practical implementation by the municipal government, including the role of the Mayor in supervision, policy implementation, and the structural obstacles encountered in the field. Furthermore, this study offers a novel perspective by identifying specific gaps between accessibility standards stipulated in regional regulations and the actual conditions of public facilities (such as sidewalks, transportation, and public buildings), as well as formulating evaluation indicators for disability rights–based policy implementation at the local level, which have not been widely explored in previous studies.
The results show that the provisions in the Regional Regulation of the Special Region of Yogyakarta Number 4 of 2012 are in accordance with Law Number 8 of 2016, as they regulate the protection and fulfillment of the rights of persons with disabilities in a more detailed and comprehensive manner. However, although the Mayor of Yogyakarta has generally made optimal efforts in carrying out his role, several shortcomings in policy implementation are still found, resulting in the rights of persons with physical disabilities not being fully realized in practice.
This study concludes that, normatively, the Regional Regulation of the Special Region of Yogyakarta Number 4 of 2012 is aligned with Law Number 8 of 2016 and serves as a strong legal basis for the protection and fulfillment of the rights of persons with disabilities. Nevertheless, policy implementation by the Mayor of Yogyakarta still faces various challenges, thus requiring increased commitment, supervision, and continuous evaluation to ensure that the fulfillment of the rights of persons with physical disabilities can be optimally achieved and truly experienced by the community.
